These Terms of Service ("Terms") govern your use of the route-surge.com website and the applications offered by RouteSurge LLC ("RouteSurge," "we," "us"), including Beacon (com.routesurge.beacon), ShipBox, and DSD Box (together, the "Apps"). By using the Apps or website, you agree to these Terms.

1. Use of the Apps

You may use the Apps only in compliance with these Terms and applicable law. You are responsible for the accuracy of the information you enter, for maintaining the confidentiality of your account credentials, and for activity under your account. You must be at least 18, or have authority to bind the business you represent.

2. Accounts and pilots

Some Apps or features may be offered as pilots, previews, or "coming soon" and may change or be discontinued. Pilot access is provided as-is and may be subject to additional written terms.

3. Fees

Where an App is offered for a fee, the price and billing terms will be presented to you before you pay. Unless stated otherwise, fees are non-refundable except where required by law. Third-party app store terms may also apply to purchases made through an app store.

6. Intellectual property

The Apps, website, and the RouteSurge name and branding are owned by RouteSurge LLC or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Apps in accordance with these Terms.

7. Third-party services and hardware

The Apps may work with third-party services and hardware, such as shipping carriers, payment processors, printers, GPS or telematics devices, and cameras. We are not responsible for third-party services, and your use of them is subject to their terms.

8. Disclaimer of warranties

OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APPS IN THE TWELVE MONTHS BEFORE THE CLAIM, OR ONE HUNDRED U.S. DOLLARS IF YOU PAID NOTHING.

10. Termination

You may stop using the Apps at any time. We may suspend or terminate access if you violate these Terms or if we discontinue an App. Sections that by their nature should survive termination will survive.

11. Changes

We may update these Terms from time to time. Continued use of the Apps after changes take effect means you accept the updated Terms.

12. Governing law and venue

These Terms are governed by the laws of the State of Montana, without regard to conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Montana, and you consent to their jurisdiction.
